PETITION FOR RULE MAKING

Updated October 24, 2025 –
On July 30, 2025, Kenneth Wayne, a licensed locksmith from Spring Lake, North Carolina, submitted a petition for rule making.  On August 11, 2025, Kenneth Wayne submitted a second petition for rule making.

The petitions propose adoption of rules regarding requirements for license renewal notifications, Board newsletters, publication of licensee information, master key systems, advertising, Board legislative activity, Board meeting accessibility, and the issuance of credentials. 

On October 1, 2025, the Board granted the petitions requested by Mr. Wayne. This begins the rulemaking process and initiates a 60-day public comment period, ending on January 16, 2026.

BOARD PROPOSED RULE MAKING

On October 1, 2025, the Board proposed several rule changes. This initiates a 60-day public comment period, ending on January 16, 2026.

Explanation:

21 NCAC 29 .0201 – To revise the manner in which examination fees are assessed
21 NCAC 29 .0202 – To codify the contents of an application to take the examination administered by the Board, as set forth in GS 74F-7
21 NCAC 29 .0204 – To clarify examination testing procedures
21 NCAC 29 .0206 – To codify the manner in which a request for a testing accommodation may be submitted to the Board
21 NCAC 29 .0501 – To clarify the manner in which an apprentice locksmith must practice under the training and supervision of a licensed locksmith, as set forth in GS 74F-7.1

PERIODIC RULES REVIEW

N.C. Gen. Stat. § 150B-21.3A requires the Board to conduct a review of its rules every ten years, determining whether each rule is necessary or unnecessary. An unnecessary rule is obsolete, redundant, or otherwise not needed. A report of the Board’s initial determination concerning each rule can be found at the link below. The report will be available for at least 60 days for the public to review and provide comment. A copy of the report is also posted on the Office of Administrative Hearings’ website. The Board will respond to any public comments by addressing the merits of each comment. After the comment period is over and the Board has had an opportunity to make its final determination, the Board will send the Rules Review Commission a report of the determinations as well as public comments received and the Board’s response.

“Public comment” is defined by N.C. Gen. Stat. § 150B-21.3A(a)(5) as a written objection to all or part of a rule. Additionally, pursuant to N.C. Gen. Stat. § 150B-21.3A(c)(2), in order for the Rules Review Commission to determine whether the public comment has merit, the public comment must address the specific substance of the rule and address any of the standards of Commission review, as set forth in N.C. Gen. Stat. § 150B-21.9(a). The deadline to submit public comment is April 15, 2025.
